Jaja is a boutique brand dedicated to creating name-customised gifts, operated by A&C Treasures LLC, a company registered in the United Arab Emirates. In this agreement, the terms “we”, “us” and “our” refer to jaja, operated by A&C Treasures LLC; “you” and “your” refers to you whether you are a customer or a website visitor. These Terms of Service (“Terms”) govern your use of our website, and the purchase of products or services offered through it. 

By accessing and/or purchasing through our website, you agree to be bound by these Terms of Service and applicable UAE laws. Please read these Terms of Service carefully before accessing or using our website. If you do not accept all the terms and conditions outlined in this agreement, you are not permitted to access the website or use our services.

SECTION 1 ELIGIBILITY

Acceptance of these terms and conditions implies that the user has the legal capacity to do so, or, failing that, has obtained authorization from a guardian or curator if legally incapacitated, from a legal representative if a minor, or holds a valid mandate if acting on behalf of a legal entity.

SECTION 2 PRODUCT AND ORDER

2.1 PRODUCT DISPLAY

Our products or service may be available solely online and are offered in limited supply. In exceptional circumstances, due to technical or system discrepancies, an item may be listed as available despite being out of stock. In such cases, we reserve the right to cancel the order and will notify you promptly of the cancellation.

 All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue or limit the quantities of any product or services that we offer. 

We strive to present the colours of our products on our website as faithfully as possible. However, the shades you see may vary depending on your screen settings and device, and we cannot guarantee an exact match to the product as received.

We make no warranties or representations, express or implied, as to the quality, accuracy, or suitability of any products or services purchased or obtained through this site. We do not guarantee that such products or services will meet your individual expectations.

2.2 PRODUCT CUSTOMISATION

We make every reasonable effort to ensure consistency in character style, font, and sizing across all personalised orders. However, we reserve the right to make necessary adjustments to the font, character shape, or text dimensions to preserve legibility, material compatibility, and overall aesthetic coherence.

By placing an order, the customer acknowledges and accepts that slight differences in font style, character formation, and sizing may arise, and that such variations are inherent to the customisation process and do not constitute defects or grounds for return or refund.

Customers are solely responsible for entering the personalised name in the correct language, script, and spelling at the time of placing the order. We do not provide translation or transliteration services, and the name will be reproduced exactly as submitted.

It is the customer’s responsibility to ensure that the name is correctly written in the desired form. We do not accept liability for errors in spelling, language choice, or character input made during the ordering process.

As a courtesy, we offer a 12-hour grace period from the time the order summary is received by the customer, during which you may contact our customer service to request a correction. After this period, the order will proceed to production and no further modifications will be accepted.

SECTION 3 PRICE & AVAILIBILITY

3.1 LOCAL PRICE 

For customers within the United Arab Emirates, all prices are displayed in AED and are inclusive of VAT and standard shipping.

3.2 INTERNATIONAL PRICE

Prices for customers outside the UAE, are shown in the local currency and payment is processed accordingly. Any applicable customs duties, import taxes, or clearance fees levied by the destination country are not included in the listed prices and remain the sole responsibility of the recipient. These charges are typically collected at the time of delivery by the relevant customs or courier authority

3.3 AVAILIBITY

SECTION 4 PAYMENT

Payment for all orders must be made in full at the time of purchase. We accept the payment methods specified on our website at checkout.

Payments are processed securely through authorised third-party payment processors. We do not store or have access to your full payment card details. 

No order shall be deemed accepted until full payment has been received and an electronic order/invoice confirmation has been issued. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or breach of these Terms. 

SECTION 5 SHIPPING & DELIVERY

5.1 Processing Time

Our standard processing time is 3 business days.
During special campaigns (e.g. pre-launch from Aug 1st 25 to Sept 15th 25), dispatch dates may be deferred as communicated.

5.2 Package Tracking

Please ensure that your delivery address, email, and phone number are entered correctly at checkout to allow for smooth delivery and accurate tracking notifications from our partner. 

We cannot be held responsible for lost packages, failed deliveries, or returned parcels due to incorrect or incomplete information.
In accordance with applicable laws on customised goods, refunds cannot be granted in these cases.

5.3 Custom & taxes

Kindly note that customs duties and import taxes are not included in the product price or shipping fees. These charges, if applicable, will be the responsibility of the customer and are typically collected at the time of delivery by the local authorities.

To ensure seamless delivery and timely customs processing, please make sure your email and phone number are entered correctly at checkout.

5.4 FORCE MAJEURE

While we strive to ensure timely delivery, we cannot be held responsible for any delays that occur outside of our control, including but not limited to customs clearance, weather disruptions, courier operational issues, or incorrect delivery information provided by the customer.

Delivery services are provided by external logistics partners, and as such, we shall not be liable for any delay, loss, or disruption caused by the performance or failure of these third-party service providers.

SECTION 6 CUSTOMMER INFORMATION ACCURACY

Customers are solely responsible for providing accurate and complete billing and contact information, including delivery address, email address, and phone number, at the time of placing the order. This information is essential for the proper execution of order processing, shipping, tracking, and, where applicable, the calculation and collection of customs duties and taxes during international delivery.

We shall not be held liable for any delays, failed deliveries, returned parcels, or loss of goods resulting from incorrect, incomplete, or outdated information provided by the customer.

In addition, we reserve the right to contact the customer regarding any matter that may require clarification, amendment, or cancellation of an order. If the customer cannot be reached due to incorrect or non-functional contact details, we shall not be liable for any consequences arising therefrom, including but not limited to, failure to deliver, automatic cancellation, or delayed fulfilment of the order.

SECTION 7 RETRUNS AND REFUNDS

Due to the personalised and made-to-order nature of our products, we do not accept returns or offer refunds, in accordance UAE national and international laws, which excludes customised products from the right of return, except in the event of a defect or an order inaccurately fulfilled.

In such cases, customers must contact us within 48 hours of receiving the item, providing a clear description and photographic evidence of the issue. No returns or replacements will be accepted without prior written approval from our customer service team.

SECTION 8 INTELLECTUAL PROPERTY

 All content on this website — including images, designs, logos, and text — is our property and protected by applicable UAE intellectual property laws, including copyright and database rights. Any unauthorised reproduction, representation, translation, adaptation, or transformation, in whole or in part, without our prior written consent or its legal rights holders, constitutes a breach of UAE intellectual property regulations and may result in legal action. By accessing the website, users agree not to use, reproduce, or represent any content from the site—whether protected by intellectual property rights or not —for any purpose other than browsing with a standard web browser or legitimate indexing by recognised search engine bots. This restriction excludes automated indexing robots whose sole function is to catalogue site content for search purposes.

SECTION 9 THIRD-PARTY SERVICES AND DATA COLLECTION

Certain advertisements displayed on this Site may be served and managed by third parties, including but not limited to advertising networks, marketing agencies, advertisers, and audience segmentation providers. These third parties may use technologies such as cookies, web beacons, or similar tracking tools to collect information about your browsing behaviour and online activity — both on this Site and across other websites — in order to deliver advertising content that is tailored to your interests.

Please be advised that we do not have access to, nor control over, the data these third parties may collect or the methods they use to do so. The data collection and usage practices of such third parties are governed by their own privacy policies and terms of service and are not covered by this Privacy Policy.

SECTION 10 PRIVACY POLICY

Your privacy is important to us. We are committed to protecting your personal information and handling it with transparency and care, in accordance with applicable data protection regulations.

10.2 DELIVERY

10.3 Data Security and Payment Information

All credit/debit card information and personally identifiable data will not be stored, sold, shared, rented, or leased to any third parties. We are committed to safeguarding your privacy and ensuring that your personal and financial information is handled in accordance with applicable data protection laws. Although payment information is required to complete your order, only the last four digits of your card may be stored securely on our servers, in compliance with industry standards and applicable regulations. Full card details are processed by secure, PCI-compliant third-party payment gateways and are never stored on our systems.

10.4 Changes to Policies

We reserve the right to modify or update our Privacy Policy and Terms & Conditions at any time to reflect legal, regulatory, or business changes. Updated versions will be posted on the website, and changes will take effect from the date of posting.

 

SECTION 11 DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY

SECTION 11.1 Extent of Liability

To the fullest extent permitted by the applicable laws of the United Arab Emirates, jaja (including its owners, directors, affiliates, employees, and agents) shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, arising from:

(a) the use of, or the inability to use, our website, products, or services;

(b) any unauthorised access to, or alteration of, your transmissions or data;

(c) any statements or conduct of any third party on the website or in connection with the services; or

(d) any other matter relating to the use of our products or services.

SECTION 11.2 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, government restrictions, pandemics, shipping or customs delays, system failures, or internet outages.

SECTION 11.3 No Warranty

Our products and services are provided “as is” and “as available,” without any express or implied warranties, except where expressly stated otherwise or required under UAE law. We do not warrant that the service will be uninterrupted, secure, or error-free, or that the quality of any products, services, or information will meet your expectations.

SECTION 11.4 Legal Jurisdiction

Nothing in this clause shall exclude or limit liability where such exclusion or limitation is not permitted by applicable UAE consumer protection laws. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

SECTION 12 GOVERNING LAW

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of UAE courts.
